Terms of Service

These Terms of Service (the 'Terms') govern your access to FaceRated, an AI-powered face, body and aesthetic analysis service operated by Facerated ('Facerated', 'we', 'us' or 'our'). By creating an account, purchasing a product or using the service, you agree to these Terms and our Privacy Policy.

You must be at least 18 years old and legally able to enter this agreement. If you use the service for an organization, you confirm that you have authority to bind that organization.

If you do not agree with these Terms, do not use the service.

FaceRated provides software tools that analyze user-provided images and information and return scores, measurements, visualizations, reports and suggestions. Features may change, be limited by availability or depend on third-party infrastructure.

The service is a digital, intangible SaaS product. Access may be provided immediately after a successful payment or after the relevant processing step completes.

AI model and provider disclosure: Face analysis uses MediaPipe Face Landmarker 0.10.14, with the Face Landmarker task model delivered from Google's MediaPipe model hosting and executed in the user's browser. AI chat features are configured for Qwen (Qwen-Turbo, Qwen-Plus and Qwen-Max) through Alibaba Cloud DashScope, DeepSeek Chat/Coder through DeepSeek, and GPT-5 models through OpenAI. Image generation is configured for Qwen-Image through Alibaba Cloud DashScope, FLUX/Qwen-Image/Nano Banana Pro/Recraft through fal.ai, DALL-E through OpenAI and Gemini image models through Google. Video generation is configured for Doubao Seedance through Volcano Engine, Wan video models through Alibaba Cloud DashScope and Kling video through fal.ai. The provider and model used can vary by feature, selected option and deployment configuration.

You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account and must notify us promptly if you suspect unauthorized access.

We may suspend or restrict access when reasonably necessary to protect the service, investigate abuse, comply with law or enforce these Terms.

Current FaceRated paid products are one-time digital purchases unless the checkout page clearly identifies a recurring product. Prices, currency, taxes and product details are shown at checkout and on the pricing page before you pay.

By completing checkout, you authorize the payment processor, Waffo Pancake, to charge the amount shown at checkout. Waffo Pancake processes card details under its own security and compliance controls; FaceRated does not store full card numbers on its servers.

If a recurring product is offered in the future, checkout will clearly disclose the billing interval and renewal amount. Completing that checkout authorizes recurring charges until you cancel under Section 6. Annual subscribers will receive a renewal reminder at least 7 days before renewal where required or offered.

One-time purchases do not renew automatically. For any recurring product that may be offered, you may cancel at any time using either method below:

• Online: Account settings - Subscription - Cancel subscription.
• Email: send the request from your registered account email to support@facerated.com.

Cancellation is processed immediately. Access remains available through the current paid billing period, and no subsequent renewal charge will be made. We will send a cancellation confirmation within 10 minutes when our email systems are available.

After cancellation, account data is retained for 90 days and then deleted in accordance with the Privacy Policy, except records we must retain for legal, security, accounting or fraud-prevention purposes.

Because FaceRated provides digital services and may provide access immediately, refunds are limited but are not excluded where this policy or applicable law provides a right to a refund.

• First-purchase 7-day guarantee: a first-time purchaser may request a full refund within 7 days of the first charge if usage has not exceeded 10% of the applicable product allowance.
• Duplicate charges caused by a billing error are refundable in full.
• If a verified FaceRated outage caused by us lasts more than 72 continuous hours, we may provide a pro-rata refund or an equivalent extension.
• Mandatory consumer cancellation, withdrawal and refund rights remain unaffected.

To request a refund, email support@facerated.com with your account email, transaction ID and reason. We will acknowledge the request within 2 business days and process an eligible refund to the original payment method within 5-10 business days.

Refunds are generally not available for used service periods, usage above the 10% threshold, purchases made more than 7 days earlier, or accounts closed for fraud or a material violation of these Terms, except where applicable law requires otherwise.

If you believe a charge is incorrect, contact support@facerated.com before filing a chargeback. Include your account email, transaction ID and a description of the issue. We aim to acknowledge billing reports within 2 business days and resolve confirmed errors within 5 business days.

AI-generated measurements, scores, reports and suggestions may be incomplete, inaccurate or out of date. They are for informational and entertainment purposes only and are not medical, legal, financial, psychological or other professional advice. Consult a qualified professional before making decisions based on any output.

Subject to these Terms, you may use output generated for your account for lawful personal purposes. You retain rights in content you submit, while granting Facerated a limited license to process it only to provide, secure and improve the requested service.

You may not use FaceRated to request, upload, generate, store or share unlawful, abusive or rights-infringing content. The following content is expressly prohibited:

• Pornography and NSFW: pornography, explicit sexual acts, sexual services or sexually explicit nudity. This prohibition applies to general adult content and is not limited to content involving minors.
• Child sexual abuse and exploitation: any sexual or suggestive content involving a minor, or content that sexualizes, exploits or endangers a minor.
• Violence and gore: graphic violence, gore, torture, mutilation, credible threats, instructions to commit violence or glorification of violent wrongdoing.
• Hate speech: content that attacks, dehumanizes or promotes hatred, exclusion or violence against a protected group or person based on a protected characteristic.
• Copyright and trademark infringement: content that uses another person's or company's copyrighted work, trademark, brand identity or other protected material without the required rights or authorization.
• Non-consensual intimate imagery, impersonation, harmful deepfakes, harassment, stalking, fraud, malware or instructions for illegal activity.

真人素材授权要求: Before uploading a real person's photograph or other identifiable material, you must own it or have permission from the rights holder and, where required, the person's consent. Do not upload an unconsented photograph of another person, private intimate material or biometric material you are not authorized to process. By using an upload control, you confirm that the material is yours or that you have the required authorization.

We use a combination of automated prompt and input checks, provider safety systems, technical access controls and human review when reasonably necessary. We may refuse a request, block or remove content, restrict a feature, suspend or terminate an account, and revoke or clear credits or quotas when we identify a violation or a legal, safety or rights-related risk. We may preserve relevant records and cooperate with lawful requests.

To report suspected prohibited content, copyright or trademark misuse, privacy abuse or unauthorized use of a person's image, email support@facerated.com with the relevant URL or account, a description of the concern and any supporting information. We review reports and take appropriate action under this AUP and applicable law.

You also may not scrape, resell, sublicense or build a competing service from the service or its outputs; train, fine-tune, benchmark or distill a competing model using the service or its outputs; or interfere with, overload or access the service through unauthorized automation.

Your use of FaceRated is subject to our Privacy Policy. We use service providers such as Cloudflare, Google, Google Analytics and Waffo Pancake where necessary to operate authentication, hosting, analytics, payments and requested AI features.

We use reasonable technical and organizational measures to protect information, but no internet service can be guaranteed completely secure.

FaceRated, its software, branding, interfaces and underlying materials are owned by or licensed to Facerated and are protected by applicable law. These Terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is permitted to access it.

The service is provided on an 'as is' and 'as available' basis. To the maximum extent permitted by law, Facerated disclaims warranties not expressly stated in these Terms, including warranties of uninterrupted availability, merchantability, fitness for a particular purpose and output accuracy.

To the maximum extent permitted by law, Facerated will not be liable for indirect, incidental, consequential or punitive damages. Our aggregate liability for a claim is limited to the amount you paid to Facerated during the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot legally be limited.

You may stop using the service at any time. We may suspend or terminate access for fraud, abuse, a material breach, security risk or legal requirement. If we terminate a paid recurring service for reasons unrelated to your breach, we will provide a pro-rata refund for unused prepaid access where applicable.

We may update these Terms. For material changes, we will provide reasonable notice. Continued use after the effective date means you accept the updated Terms.

Using FaceRated, creating an account or agreeing at checkout confirms that you have read and accepted these Terms.
